Terms and Conditions of Sale

1. Business Details

These Terms and Conditions govern all sales by:

By purchasing goods from us, either via our website or via our outlet in The Merchants Warehouse, you agree to these Terms and Conditions.

2. Definitions

"Goods" means all second-hand, vintage, antique, collectable, decorative, artwork, furniture, jewellery, watches, memorabilia, and other items offered for sale by us.

"Customer" means the purchaser of the Goods.

3. Nature of Goods

The Customer acknowledges that:
  • Goods sold by us are primarily second-hand, vintage, antique, or collectable items.

  • Such Goods may exhibit signs of age, wear, repairs, restoration, patina, fading, imperfections, or other characteristics consistent with their age and history.

  • These characteristics are not considered defects where they have been disclosed, photographed, described, or would reasonably be expected from an item of that age and nature.

4. Product Descriptions

We make reasonable efforts to accurately describe all Goods.
However:
  • Colours may vary due to lighting, photography, and screen settings.

  • Measurements are approximate.

  • Statements regarding age, origin, maker, period, provenance, authenticity, rarity, or value are based on information reasonably available to us at the time of sale.

Unless expressly stated in writing, no warranty is given regarding investment value, future appreciation, or collectability.

5. Pricing

All prices are stated in Australian Dollars (AUD).
Unless otherwise stated:
  • Prices include GST where applicable.

  • Delivery, shipping, insurance, customs duties, taxes, or import charges are additional.

Prices may change without notice prior to purchase.

6. Payment

Payment must be received in full before Goods are released or dispatched.
Accepted payment methods may include:
  • Cash

  • Bank transfer

  • EFTPOS

  • Credit card

  • Other payment methods as advised

Ownership of Goods remains with us until full payment has been received.

7. Shipping and Delivery

Delivery times are estimates only. We are not responsible for delays caused by:

  • Carriers

  • Customs authorities

  • Weather events

  • Industrial action

  • Circumstances beyond our reasonable control

Risk in the Goods passes to the Customer upon collection or delivery to the carrier. Customers are encouraged to obtain shipping insurance for valuable items.

8. Inspection Prior to Purchase

Where Goods are available for inspection, Customers are encouraged to inspect them before purchase. Failure to inspect does not entitle the Customer to reject the Goods based on characteristics that would have been apparent upon reasonable inspection.

9. Returns and Refunds

We comply with the Australian Consumer Law. Nothing in these Terms excludes, restricts, or modifies any rights or remedies available under the Australian Consumer Law. Subject to those rights:

  • Change-of-mind returns are not accepted.

  • Deposits are non-refundable unless otherwise agreed in writing.

  • Special orders and custom items are non-refundable.

Where a remedy is available under the Australian Consumer Law, we will provide the appropriate remedy.

10. Authenticity and Provenance

Where authenticity, provenance, maker, artist attribution, or historical information is provided, it is based on information reasonably available at the time of sale.
Unless expressly stated in writing:

  • No independent expert certification is provided.

  • No guarantee is given regarding future expert opinions.

  • Subsequent differing opinions do not automatically entitle the Customer to a refund.

11. Watches, Jewellery and Mechanical Items

Vintage watches, clocks, jewellery, cameras, mechanical devices, and similar items are sold in their condition at the time of sale. Servicing may be required after purchase at your own cost.
Unless expressly stated in writing:

  • No guarantee is given regarding water resistance.

  • No guarantee is given regarding future accuracy or performance.

12. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, special, or consequential loss.

  • Our liability is limited to the purchase price of the Goods concerned.

This clause does not limit any rights that cannot lawfully be excluded under the Australian Consumer Law.

13. Force Majeure

We are not liable for failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control.

14. Privacy

Personal information collected during transactions will be handled in accordance with applicable Australian privacy laws and used only for legitimate business purposes.

15. Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia.
Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.

16. Amendments

We may update these Terms and Conditions from time to time. The version in force at the date of purchase will apply to the transaction.
